How a matter proceeds

Common questions
A cheque given to me has bounced. What are the time limits?
A written demand notice must go within 30 days of the bank's return memo. The drawer then has 15 days to pay. If they don't, a complaint can be filed within one month after those 15 days end.
Do I need an arbitration clause in my contracts?
Not always, but a well-drafted dispute resolution clause, including the seat of arbitration, decides where and how fast a dispute will be heard. It is worth getting right before signing.
Is mediation compulsory before a commercial suit?
Under s.12A of the Commercial Courts Act, 2015, pre-institution mediation is mandatory unless the suit seeks urgent interim relief.
