Common questions
When can the High Court quash an FIR?
The High Court's inherent power under s.528 BNSS (formerly s.482 CrPC) is used to prevent abuse of process or to secure the ends of justice, for example where the FIR discloses no offence, is plainly mala fide, or where a largely private dispute has been settled. Each case turns on its facts.
What is the difference between anticipatory and regular bail?
Anticipatory bail is sought before arrest, from the Sessions Court or High Court. Regular bail is sought after arrest. Which applies, and where to file, depends on the offence and the stage of the case.
What rights do I have if I am arrested?
You must be told the grounds of arrest, may consult an advocate of your choice, can have a relative or friend informed, and must be produced before a Magistrate within 24 hours.
